1. Scope and Acceptance
These Terms of Service (“Terms”) govern your access to and use of SwappdAI (“SwappdAI”, “we”, “us”).
By accessing or using our website, mobile application, or services, you agree to be bound by these Terms.
If you do not agree, you must not use the service.

3. Description of the Service
SwappdAI provides AI-powered image transformation services, including but not limited to:
Fun Cards
Art Lab Cards
Swap Me Cards
The service allows users to upload images and generate AI-transformed results based on selected templates and styles.
4. Eligibility and User Responsibilities
By using SwappdAI, you confirm that:
You are at least 13 years old (or 16, where required by local law)
You have the legal right to upload and use all images provided
You do not violate any applicable laws or third-party rights
You are solely responsible for all content you upload and generate using the service.
5. User Accounts, Plans, and Credits
a) Plans
SwappdAI offers different access tiers, including:
Free Plan
Includes a limited number of monthly credits and access to selected Fun CardsPremium & Pro Creator Plans
Include full access to all cards, features, and advanced options
b) Credits
One credit is consumed per successful image generation.
Credits may be included as part of a subscription plan or purchased separately in bundles.
All credits, regardless of plan type or purchase method, are non-transferable and do not roll over into subsequent billing periods.
Unused credits expire at the end of the applicable billing cycle or validity period, unless explicitly stated otherwise.
Credits have no cash value and cannot be exchanged for money or transferred to other users.
c) Gallery Storage Limits
To ensure optimal app performance and server stability, SwappdAI limits the number of original images (“Original Images”) that users may store in their personal gallery at any given time.
Original Images refer to photos uploaded or captured by the user.
The following limits apply based on the selected plan:
Free Plan: Maximum of 10 Original Images
Premium Plan: Maximum of 50 Original Images
Pro Creator Plan: Maximum of 200 Original Images
If the applicable limit is reached, users must delete existing Original Images from their gallery before uploading or capturing new ones.
AI-generated images are stored separately from Original Images and may be subject to different storage or retention periods as required for service operation, performance optimization, or legal compliance.
SwappdAI reserves the right to adjust gallery limits or storage policies at any time in accordance with Section 9 and Section 12 of these Terms
6. Payments and Refunds
Payments are processed via third-party payment providers
Due to the digital and immediate nature of AI processing, all purchases are final
No refunds are provided for used or unused credits unless required by law
7. Use of AI Technology
a) Source Images
You must only upload images you own or are legally permitted to use.
b) Prohibited Use
You may not use SwappdAI to generate content that is:
Illegal
Defamatory or deceptive
Pornographic or sexually explicit
Harmful, abusive, or misleading
We reserve the right to suspend or terminate accounts that violate these rules.
c) Output Variability
AI-generated images may vary in quality and appearance.
SwappdAI does not guarantee specific results or likeness accuracy.
8. Intellectual Property
a) Your Content
You retain ownership of the original images you upload.
b) Generated Content
SwappdAI grants you a non-exclusive, worldwide license to use generated images:
For personal use on all plans
For commercial use, depending on your plan level
c) Platform Assets
All software, designs, trademarks, logos, and interfaces remain the exclusive property of SwappdAI.
9. Service Availability
We strive to provide uninterrupted service but do not guarantee:
Continuous availability
Error-free operation
Permanent access to specific features or cards
Features, templates, or pricing may change or be discontinued at any time.
10. Limitation of Liability
SwappdAI is provided “as is” and “as available”.
To the maximum extent permitted by law:
We are not liable for indirect, incidental, or consequential damages
We are not responsible for user-generated or AI-generated content
Use of generated images is at your own risk
11. Termination
We may suspend or terminate access to the service at any time if:
These Terms are violated
Misuse or abuse of the service is detected
Required by law or platform policies
12. Changes to These Terms
We may update these Terms at any time.
Continued use of SwappdAI after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the country in which the service provider operates, excluding conflict-of-law rules.
14. Email Communications (Product Updates & Marketing)
a) Service and Product Emails
We may send you emails that are necessary to provide and operate SwappdAI, including account-related messages, security notifications, billing information, credit usage, and important service updates.
b) Marketing Emails
If you provide your email address and give your explicit consent (opt-in), we may send you marketing emails, including promotions, special offers, and product announcements.
You can withdraw your consent at any time by clicking the unsubscribe link in any marketing email or by contacting us at hello@swappdai.com. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
